Pursuant to the 14th Amendment, can Trump serve as president?

Debate Information

Hello:

United States Constitution, 14th Amendment, Section 3,

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same.

If the words mean what they say, Trump may NOT serve.

Yeah, just a bunch of tourists..  Nothing to see here..

Trump supporters including one holding a baseball bat and grabbing a police shield clash with police and security forces outside a tunnel into the US Capitol

What a thing to say on the anniversary of an insurrection Trump inspired

If you believe that Trump has partaken in insurrection or rebellion against the regime, feel free to bring the charge to the court. Of course, no reasonable court will agree with you. "Insurrection" and "rebellion" are very strong words, and making a few ambiguous statements with respect to one's followers storming the Capitol without his explicit directive certainly does not qualify as either of those.

Trump has been elected democratically, and all criminal charges brought against him so far has not resulted in a single jail/prison sentence. Please respect the democracy, even (or especially) when it does not go your way.

    Hello May:

Nahhh....  You talk about me not respecting democracy in the same thread where you disrespect the Constitution..  You can't have it both ways.

Oh, please make no mistake: I do not respect either. But you have been talking about democracy a lot - in a positive light - so it would be logical for you to oppose this kind of legal trickery. Do you think the US population would take it lightly? One of the major reasons Trump won is because the population felt like the government was dismissing its voices - and not allowing the democratically elected president to enter the office will make January 6th look like a morning stroll in comparison.

Democrats created the fake insurrection scenario to hide their voting fraud theft of the 2020 election.  Trump never engaged in insurrection but democrats like NancyPelosi, Adam Schiff, Mark Milley, Merrick Garland, Alvin Bragg, Letitia James, Ltc. Vindman, Jack Smith, Chris Wray, Joe Biden, hundreds of news outlets, and dozens of politicians did.

    Hello again, May:

The Constitution is not a popularity contest.   The words MEAN, what the words SAY, and you don't like it, so you attack me, a guy who can actually READ and loves his country.

Nice pic you provided but do you have say a video capturing Trump partaking in the riot or verbally encouraging a violent insurrection on site or from where he was? No, no smoking gun? Just your desire for him not to be president again? Sorry but emotionalism doesn't trump constitutional law. Trump is YOUR newly elected president.

    Hello Fact:

It's true.  There's no smoking gun..  But, he "lit the fire".

Fact is, Trump engaged in a multi-part conspiracy to overturn the lawful results of the 2020 election, and failed to act to stop his supporters from attacking the Capitol.  Those are incontrovertible facts.  Ipso facto, Trump, SHALL have ENGAGED in insurrection..  The word "shall", doesn't mean he could have, or might have.  It means he actually ENGAGED in insurrection..  The meaning is clear.

So, what you say is true.  At the present time, Trump IS my president..  But, not for long.

The democrats stole the 2020 election by fraud and cooked up the fake sedition scheme to cover up their seditious crime.  nevertheless, Trump was never convicted of sedition so the whole argument falls completely apart.

Jack Smith couldn't prove beyond 100% that Trump incited the insurrection. After T incited and provoked anger and emboldened his supporters to do his bidding, he knew, being the seasoned thug he is, that he needed to cover up his dirty deed by simply adding  "go in peace" at the end.

I cannot get past this election. What are the chances that Biden, the FBI, the CIA and the DOJ not staying vigilant this past four years on Trump's dirty deeds and antics? The DOJ is investigating heavily.

Imagine, the people of America voted for and support 100% the presidency of man-boy who calls the governor of CA "Gavin Newscum".

    Hello, Delilah:

Nice to see you again.  Even IF the DOJ is heavily investigating, Merrick Garland waited too long.  I'm afraid our democracy is toast.  I'm going to bed now..  Wake me when it's over.

I don't get what your issue is Jack? Sounds like the run of the mill democrat politician only republicans never had the guts to weaponize the attorney generals office like the democrats have done.

Trump has endured repeated attacks from leftists, including physical and verbal and has been charged with crimes he did not commit.  He has been unjustly and illegally impeached on the basis of false accusations and seditious efforts by democrats to destroy him for political reasons.

It is not that simple. First, the Constitution is a dynamic document which has no legal power unless the governed consent to it. Second, what the words in a legal document mean is never trivial. This is exactly why we have legal scholars, as well as the Supreme Court: to interpret the Constitution accurately.

I am not a Trump supporter, and I am not interested in any wars or clashes. I was having a very civil conversation with you - and, apparently, accidentally poked at something sensitive. My apologies.
